Legal & Financial Perspective in One Representation
Our attorneys hold backgrounds as certified accountants in addition to their legal credentials. That distinction matters in domestic violence cases because financial control, shared accounts, marital property, and support obligations are often at the center of what a client needs resolved, not just the protective order itself. We can address both dimensions without requiring you to coordinate between separate firms.
Our representation is built around each client’s specific goals. We apply aggressive advocacy when it serves you and measured strategy when that approach works better. There’s no default posture, because no two domestic violence cases in McHenry County are identical.
What Comprehensive Representation Looks Like
We represent both petitioners and respondents. For those seeking protection, that means preparing a strong petition, coordinating with any existing family law proceedings, and anticipating how an order of protection can interact with custody or support arrangements. For those responding to allegations, it means thorough case evaluation, identifying relevant facts, and protecting your rights through each stage of the McHenry County Circuit Court process.
Handling a domestic violence matter within a family law context means custody modifications, support changes, and property access can all be addressed within the same representation. We approach every case with the preparation it would require at trial while remaining open to resolutions that better serve your objectives. Our representation is compassionate and nonjudgmental throughout. What you share with us stays focused on building a strong case for you.
Orders of Protection in McHenry County: How the Process Works
Orders of protection in McHenry County are filed through the McHenry County Circuit Court, part of the 22nd Judicial Circuit. Illinois law provides three types: emergency orders, interim orders, and plenary orders. Emergency orders of protection are typically granted the same day, without notifying the respondent, and may last up to 21 days. A plenary order is decided at a full hearing where both parties have the opportunity to present evidence.
Filing & Scheduling
Petitions can be initiated through the Illinois Protection Order Portal at illinoisprotectionorder.org, which provides guided forms tailored to your situation. There are no filing fees for obtaining a protection order or for service on the respondent. Remote appearances may be available for emergency protective orders. Domestic violence matters in the 22nd Judicial Circuit are generally heard Monday through Friday, with OP summons and motions heard at 9:00 a.m. and other domestic violence matters at 1:30 p.m.
Who Qualifies for Protection
Under the Illinois Domestic Violence Act, orders of protection apply to family or household members, including:
- Spouses and former spouses
- People who share or have shared a home
- Individuals who have a child in common
- People in a current or past dating relationship
- People with disabilities and their personal assistants
What an Order Can Require
An order of protection can require the respondent to vacate a shared residence, refrain from any contact, surrender firearms, or pay financial support, among other remedies. Violating an order is a criminal offense under Illinois law. Turning Point is a free domestic violence advocacy organization that assists McHenry County residents with protection order petitions at the courthouse in Woodstock. Spanish-speaking advocates are available. Turning Point is an independent community resource, not affiliated with our firm.
How Domestic Violence Allegations Affect Custody, Divorce, & Support in McHenry
Domestic violence allegations can significantly affect allocation of parental responsibilities and parenting time decisions in Illinois family court. An order of protection may impose temporary custody or visitation limitations while a case is pending, and courts take those circumstances into account when making longer-term determinations.
In a divorce proceeding, a history of domestic violence can affect how courts approach parenting determinations and support obligations. A protective order that excludes a spouse from the marital home raises immediate questions about housing, access to shared finances, and support. Illinois courts may issue temporary orders addressing custody, support, and property access alongside or following a protective order, and the financial stakes can escalate quickly when that happens.
Because we handle both domestic violence matters and the related family law proceedings, we can evaluate how these overlapping issues affect each other from the start, rather than addressing them in separate, disconnected proceedings.
